Chief Justice SV Gangapurwala and Justice D Bharatha Chakravarthy directed the TN Advocate General, R Shunmugasundaram, to take instructions on the same by March 4 this year.

The Madras High Court Tuesday directed the Tamil Nadu government to consider providing one percent horizontal reservation for transgender persons across all caste categories in State run educational institutions and jobs.

মঙলবাৰে মুখ্য ন্যায়াধীশ সঞ্জয় বিজয়কুমাৰ গংগাপুৰৱালা আৰু ন্যায়াধীশ ডি ভাৰত চক্ৰৱৰ্তীৰ প্ৰথমখন বিচাৰপীঠে হিজড়া কৰ্মী গ্ৰেচ বানুৱে উত্থাপন কৰা জনস্বাৰ্থৰ ৰিট আবেদনৰ শুনানি গ্ৰহণ কৰি এই পৰামৰ্শ আগবঢ়ায়।

 যিহেতু ই ৰাজ্যৰ উচ্চতম পৰ্যায়ত লোৱা নীতিগত সিদ্ধান্ত, সেয়েহে আদালতে অধিবক্তা প্ৰধান আৰ শুনমুগাসুন্দৰামক ৪ মাৰ্চৰ ভিতৰত চৰকাৰৰ পৰা নিৰ্দেশনা ল’বলৈ নিৰ্দেশ দিয়ে।

The first bench of Chief Justice Sanjay Vijaykumar Gangapurwala and Justice D Bharatha Chakravarthy made the suggestion on Tuesday, while hearing a public interest writ petition moved by transgender activist Grace Banu.

Since it is a policy decision to be taken at the highest level of the state, the court instructed advocate-general R Shunmugasundaram to get instructions from government by March 4.

আবেদনকাৰীৰ মতে, ৰাজ্যখনত প্ৰচলিত বৰ্তমানৰ নীতিৰ অধীনত নিজকে নাৰী বুলি পৰিচয় দিয়া হিজৰাসকলে সকলো জাতি শ্ৰেণীৰ মহিলাৰ বাবে প্ৰদান কৰা অনুভূমিক সংৰক্ষণ উপভোগ কৰিবলৈ পায়।

According to the petitioner, under the present policy prevailing in the state, transgender people who identify themselves as women get to enjoy horizontal reservation provided for women across all caste categories.

কিন্তু যিসকলে নিজকে পুৰুষ বা তৃতীয় লিংগ বুলি পৰিচয় দিয়ে, তেওঁলোকক হয় নিজৰ নিজৰ জাতি শ্ৰেণীৰ অধীনত নহয় এমবিচি শ্ৰেণীৰ অধীনত গণ্য কৰা হয় বুলিও কয় ।

 আবেদনকাৰীয়ে আৰু আঙুলিয়াই দিয়ে যে কৰ্ণাটক চৰকাৰে সকলো জাতি শ্ৰেণীৰ হিজড়াৰ বাবে ১% অনুভূমিক সংৰক্ষণ প্ৰদানৰ নীতি ৰচনা কৰিছে.

However, those who identify themselves as men or third gender, are considered either under their respective caste category or under the MBC category, she said.

The petitioner further pointed out that the Karnataka government had come up with a policy of providing 1% horizontal reservation for transgender people across all caste categories.

দাখিল কৰা তথ্যসমূহ লিপিবদ্ধ কৰি বিচাৰপীঠে লক্ষ্য কৰে যে তামিলনাডু চৰকাৰেও এনে সমাধানৰ কথা বিবেচনা কৰিব পাৰে।

Recording the submissions, the bench observed that the Tamil Nadu government could also consider such a solution.

আদালতে আৰু আঙুলিয়াই দিয়ে যে ২০১৪ চনৰ নালছাৰ ৰায়দানত উচ্চতম ন্যায়ালয়ে কেন্দ্ৰটোৰ লগতে সকলো ৰাজ্যকে হিজড়াসকলৰ বাবে সংৰক্ষণৰ ব্যৱস্থা কৰিবলৈ নিৰ্দেশ দিছিল যাতে তেওঁলোকক মূলসুঁতিৰ সমাজত একত্ৰিত কৰিব পৰা যায়।

The court further pointed out that Supreme Court in the 2014 NALSA judgement directed the centre as well as all states to provide reservations for transgender people so they could be integrated into mainstream society.
